Secondary use of health data can accelerate research, innovation and better care—one of the core ambitions of the European Health Data Space (EHDS).
However, when health data is linked to IP, know‑how and commercially confidential information, the lack of clear operational safeguards can discourage sharing.
⛓️💥Key gaps include:
• Loss of control / limited traceability once data (or outputs) are shared
• Unclear procedures for IP-sensitive secondary use
• Inconsistent decisions across Member States
• Emerging IP risks linked to AI and GenAI
🛡️FORTIFY is developing, testing and validating an integrated set of legal, governance and technical solutions to enable IP-sensitive secondary use of health data within the EHDS. The FORTIFY framework includes legal guidance, model contracts/ template clauses, a technical toolkit supporting traceability and watermarking, real‑world validation, as well as training and policy recommendations.
